COPYRIGHT AND DMCA POLICY – PassionWear Studio

PassionWear Studio LLC, a limited liability company organized in the State of New Mexico, United States (“PassionWear Studio,” “PWS,” “we,” “us,” or “our”), respects the intellectual property rights of others and expects customers and users of passionwearstudio.com (the “Site”) to do the same.

This Copyright and DMCA Policy explains how copyright owners may report material appearing on the Site that they believe infringes their rights and how an affected party may submit a counter-notification. This Policy also applies, where appropriate, to customer-uploaded images, artwork, text, and other content submitted for personalized products.

1. COPYRIGHT POLICY

You may not upload, submit, request, purchase, or otherwise use content through the Site unless you own the content or have all permissions, licenses, and other rights necessary for the requested use, reproduction, modification, printing, production, and fulfillment.

PassionWear Studio may reject an order, decline to print content, remove or disable access to material, cancel an account, or take other appropriate action when we reasonably believe that content infringes copyright, violates another person’s rights, violates our policies, or creates legal or operational risk.

We reserve the right to review content, but we are not obligated to determine the ownership or legality of every image, design, phrase, or other submission before accepting or fulfilling an order.

2. SUBMITTING A COPYRIGHT INFRINGEMENT NOTICE

If you are a copyright owner or are authorized to act on behalf of one and believe that material available on the Site infringes a copyright, you may send us a written notice under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. Section 512.

To be effective, the notice should include substantially all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

2. Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works on the Site are covered by one notice, a representative list of those works;

3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for us to locate it. Please provide the exact URL of each relevant page or product whenever possible;

4. Information reasonably sufficient for us to contact you, such as your full legal name, mailing address, telephone number, and email address;

5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the owner’s agent, or the law; and

6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the allegedly infringed exclusive right or are authorized to act on the owner’s behalf.

Supporting information, such as copyright registration details, original publication links, dated source files, or a brief explanation comparing the copyrighted work with the reported material, may help us evaluate the notice but does not replace the required statements above.

Email is the preferred method for prompt review. A notice that omits required information may be delayed, rejected, or returned for completion.

3. WHAT HAPPENS AFTER WE RECEIVE A NOTICE

After receiving a substantially complete copyright notice, we may:

– Review the notice and request additional information;

– Remove or disable access to the reported material;

– Suspend production or fulfillment of an affected order when reasonably possible;

– Cancel or restrict an account or order;

– Notify the person who submitted or is responsible for the affected material;

– Provide a copy of the notice, including the claimant’s contact information, to the affected person or relevant service provider;

– Forward relevant information to our hosting, payment, production, fulfillment, marketplace, or other service providers; and

– Take any other action we consider appropriate under our policies and applicable law.

Removal of material does not necessarily constitute an admission that infringement occurred. We may remove or decline to restore content for reasons independent of the DMCA, including violations of our Terms, intellectual property policy, product rules, or acceptable-use requirements.

Because print-on-demand orders may enter production shortly after submission, we cannot guarantee that a copyright notice received after production begins will stop the manufacture or shipment of an affected order. We will take action that is reasonably available under the circumstances.

4. COUNTER-NOTIFICATION

If material that you submitted was removed or disabled as a result of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send us a written counter-notification.

To be effective, a counter-notification should include substantially all of the following:

1. Your physical or electronic signature;

2. Identification of the material that was removed or to which access was disabled and the location where the material appeared before removal or disabling;

3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;

4. Your full legal name, mailing address, telephone number, and email address;

5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, to the jurisdiction of a Federal District Court in which PassionWear Studio LLC may be found; and

6. A statement that you will accept service of process from the person who submitted the original copyright notice or that person’s agent.

DMCA Counter-Notification

If we receive a valid counter-notification, we may forward it, including your contact information, to the original claimant. Subject to applicable law and our independent policies, the removed material may be restored not fewer than 10 and not more than 14 business days after receipt of the counter-notification unless we first receive notice that the claimant has filed a court action seeking to restrain the allegedly infringing activity.

Submitting a counter-notification does not guarantee that an order will resume, that canceled production can be restarted, or that material will be restored when it independently violates our policies.

5. REPEAT INFRINGERS

In appropriate circumstances, PassionWear Studio may restrict or terminate accounts, reject orders, block access, or discontinue service for users whom we reasonably determine to be repeat infringers.

We may consider the number, timing, nature, reliability, and outcome of infringement notices and counter-notifications, as well as other relevant circumstances. We may also take action after a single serious or willful infringement when appropriate.

6. CUSTOMER-UPLOADED CONTENT

By uploading or submitting content for a personalized product, you represent and warrant that:

– You own the content or have permission and all rights necessary for PassionWear Studio and its production and fulfillment providers to reproduce, modify as technically necessary, print, manufacture, and deliver the requested product;

– The requested use does not infringe copyright, trademark, privacy, publicity, or other rights;

– The content does not violate applicable law or our policies; and

– Information you provide about your rights to the content is accurate.

We may require evidence of ownership, authorization, or licensing before processing content. We may refuse content containing brand logos, characters, artwork, photographs, names, likenesses, or other protected material when sufficient authorization is not provided.

7. TRADEMARK, PUBLICITY, AND OTHER RIGHTS

The DMCA notice-and-counter-notice process applies specifically to copyright claims. Trademark, right-of-publicity, privacy, counterfeit, and other intellectual property complaints are not DMCA notices, although we may review them through a similar process.

– Your name and contact information;

– Identification of the right you claim;

– Any registration number or supporting documentation;

– The exact URL or description of the reported material;

– An explanation of why you believe the material violates your rights; and

– A statement that the information provided is accurate and that you are the rights owner or are authorized to act for the owner.

8. MISREPRESENTATIONS

Under 17 U.S.C. Section 512(f), a person who knowingly and materially misrepresents that material is infringing or that material was removed or disabled by mistake or misidentification may be liable for resulting damages, including costs and attorneys’ fees.

Before sending a notice or counter-notification, consider whether the disputed use may be authorized by a license or permitted by law, including under the doctrine of fair use. If you are uncertain, you may wish to obtain legal advice.

9. PRIVACY AND DISCLOSURE

Copyright notices and counter-notifications are legal communications. We may disclose them and the personal information they contain to the person who submitted the affected material, the claimant, service providers, legal advisers, courts, government authorities, or others where reasonably necessary to process the claim, enforce our rights, or comply with law.

Do not include sensitive information that is not required for the notice or counter-notification.

10. CHANGES TO THIS POLICY

We may update this Policy to reflect changes in our Services, business practices, or legal obligations. The revised version will be posted on the Site with an updated Effective Date.
