This Returns, Cancellations, and Refunds Policy applies to purchases made through passionwearstudio.com (the "Site"), operated by PassionWear Studio LLC, a limited liability company organized in the State of New Mexico, United States ("PassionWear Studio," "PWS," "we," "us," or "our").
Most of our products are printed or produced on demand. Please review product details, size charts, personalization information, shipping address, and order quantities carefully before submitting an order.
Nothing in this Policy limits any non-waivable rights available to you under applicable consumer-protection law.
1. ORDER CANCELLATIONS AND CHANGES
If you need to cancel or change an order, contact us at [email protected] as soon as possible and preferably within one hour after placing the order.
Please include your order number and clearly describe the requested cancellation or change. A request is not approved until you receive confirmation from PassionWear Studio.
Orders may be submitted to production shortly after payment is confirmed. Once an order has entered production or fulfillment, it generally cannot be canceled or changed. This includes changes to the product, size, color, design, personalization, quantity, or shipping address.
Submitting a request within one hour does not guarantee that we can complete it. If we successfully cancel an order before production begins, we will issue a refund to the original payment method. If the order has already entered production, it may no longer qualify for cancellation or a refund based solely on the cancellation request.
2. RETURN AND REFUND REQUEST PERIOD
If your order arrives with an eligible problem, contact us within 30 days after the recorded delivery date.
For packages that have not arrived, contact us after reviewing the tracking information and within 30 days after the latest estimated delivery date or the carrier's notice of loss.
Requests submitted after the applicable 30-day period may not qualify for a replacement or refund, except where otherwise required by law.
3. ELIGIBLE ORDER ISSUES
We will review requests involving the following issues:
- The product arrived damaged or defective;
- The product received is different from the product ordered;
- The design, size, color, or style received is different from the confirmed order;
- The product has a significant printing or production defect, such as materially blurry, faded, incomplete, peeling, or seriously misaligned printing;
- One or more items are missing from the package;
- The product materially differs from its description on the Site; or
- The package is confirmed by the carrier as lost in transit or delivered to an incorrect address through no fault of the customer.
Depending on the circumstances, available inventory, production capability, and applicable law, we may offer a replacement, reprint, refund, or another appropriate resolution. We may choose the remedy unless applicable law gives you the right to select one.
Minor variations that are normal for print-on-demand manufacturing, including slight differences in color, print placement, dimensions, or appearance compared with an electronic display, are not necessarily defects.
4. ISSUES THAT GENERALLY DO NOT QUALIFY
Except where required by law or expressly approved by us, we generally do not provide returns, replacements, or refunds for:
- Selecting the wrong size, color, style, product, or quantity;
- A change of mind, buyer's remorse, or no longer wanting the product;
- An incorrect or incomplete shipping address provided by the customer;
- Personalization errors contained in information, text, spelling, images, or artwork supplied or approved by the customer;
- Customer-uploaded content that prints as submitted but does not meet the customer's expectations;
- Products that have been materially altered, intentionally damaged, or improperly used by the customer;
- Damage caused by failure to follow reasonable care instructions;
- Minor color differences caused by screen settings, fabric, printing method, or normal production variation;
- A package delayed by the carrier, customs processing, weather, or another event outside our reasonable control when the package remains in transit;
- A package marked as delivered to the shipping address provided by the customer, unless the carrier confirms misdelivery or loss;
- A package that could not be delivered, was refused, or was returned because of an incorrect address, failure to collect, unpaid customs charges, or another circumstance attributable to the customer; or
- A request submitted outside the applicable request period.
If an item appears to have been used or washed, we may still review a claim when the reported defect could reasonably have become apparent only after normal initial use or washing.
5. HOW TO REQUEST A REPLACEMENT OR REFUND
Email [email protected] and include:
- Your full name;
- Your order number;
- A clear description of the issue;
- A photo showing the entire product;
- Clear photos of the front and back of the product, where applicable;
- Close-up photos showing the damage, defect, or incorrect details;
- Photos of the packaging and shipping label; and
- Any relevant carrier notice or tracking information.
For missing items, include photos of everything received, the packaging, and the shipping label. For delivery issues, we may ask you to contact the carrier and provide a case number, written confirmation, or other documentation.
Please do not send complete card numbers, card security codes, account passwords, or other sensitive authentication information by email.
We may request additional reasonable information needed to verify the issue. Failure to provide sufficient evidence may delay the review or prevent us from approving the request.
6. REPLACEMENTS AND REPRINTS
If a replacement or reprint is approved, it will generally match the product specifications in the original order. Replacement items cannot normally be changed to a different design, size, color, style, or product.
We will provide replacement production and shipping information when available. Production and delivery estimates are not guarantees and may be affected by product availability, carrier conditions, customs processing, or events outside our reasonable control.
An approved replacement is intended to resolve the reported issue. A second replacement or refund may be considered if the replacement itself arrives with an independently verified eligible defect or error.
7. RETURNS
Do not return an item without first contacting us and receiving written return authorization and instructions.
Because our products are made to order and fulfilled by third-party production partners, a physical return is generally not required unless PassionWear Studio specifically requests one. Packages sent to an address shown on the original shipping label or to a production partner without authorization may not be received, stored, or returned to you, and may not qualify for a refund.
If we require a physical return because of our error, a production defect, or an incorrect item, we will provide instructions and determine whether return shipping will be prepaid or reimbursed. If a discretionary return is approved for a reason not caused by us, the customer may be responsible for return shipping and the original shipping charge may be non-refundable, to the extent permitted by law.
When a return is authorized, the item must be sent according to our instructions, using suitable packaging and, where requested, a trackable shipping method. We are not responsible for unauthorized returns or return packages lost because the customer did not follow the provided instructions.
8. REFUNDS
Approved refunds are generally issued to the original payment method and in the original transaction currency. Depending on the resolution, a refund may cover the affected item, the entire order, and/or applicable original shipping charges.
After we submit a refund, Stripe, PayPal, your bank, or your card issuer may require additional processing time before the funds appear in your account. We do not control those processing times.
We generally cannot refund exchange-rate differences, foreign-transaction fees, currency-conversion fees, customs duties, or other charges imposed by a bank, payment provider, carrier, broker, or government authority.
9. LOST, DELAYED, OR DELIVERED PACKAGES
A shipping delay does not automatically mean that a package is lost. If tracking remains active or the package is delayed by the carrier or customs, we may ask you to allow additional delivery time or cooperate with a carrier investigation.
If the carrier confirms that a package was lost in transit or delivered to an incorrect address through no fault of the customer, we may provide a replacement or refund after reviewing the claim.
If tracking shows that a package was delivered to the address supplied at checkout but you cannot locate it, please:
- Confirm the shipping address in your order;
- Check with household members, neighbors, mailrooms, reception areas, or other safe delivery locations;
- Allow a short period in case the carrier marked the package delivered early; and
- Contact the carrier to request delivery confirmation or open an investigation.
We will review the matter when you provide the carrier's case number or findings. We cannot guarantee a replacement or refund for a package correctly delivered to the address provided and subsequently lost or stolen.
10. CUSTOMER-PROVIDED ADDRESSES AND CUSTOMS
Customers are responsible for providing a complete and accurate shipping address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after the order enters production or fulfillment.
If an order is returned, lost, destroyed, or undeliverable because the customer supplied an incorrect or incomplete address, refused delivery, failed to collect the package, or failed to pay required customs or import charges, replacement and reshipping costs may be the customer's responsibility.
Customs delays are outside our direct control. A package delayed in customs does not qualify for a refund solely because of the delay unless otherwise required by law.
11. PAYMENT DISPUTES
If you believe a charge or refund is incorrect, contact us promptly at [email protected] so we can investigate. This does not prevent you from exercising any rights provided by your card issuer, PayPal, or applicable law.
When responding to a payment dispute or chargeback, we may provide relevant order, payment, production, communication, and delivery records to the payment processor or financial institution.
12. POLICY ABUSE
We reserve the right to refuse a request when we reasonably determine that it is fraudulent, abusive, based on altered evidence, or inconsistent with the order records. This provision does not limit any non-waivable consumer rights.
13. CHANGES TO THIS POLICY
We may update this Policy to reflect changes in our products, fulfillment practices, carrier requirements, or legal obligations. The revised Policy will be posted on the Site with an updated Effective Date. The version in effect when an order was placed will generally govern that order, except where applicable law requires otherwise.
