These Terms of Use (“Terms”) govern your access to and use of passionwearstudio.com (the “Site”) and purchases from PassionWear Studio LLC (“PassionWear Studio,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility and Acceptance

You must be legally able to enter into a binding agreement in your jurisdiction to use the Site or place an order. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization. We may update these Terms from time to time by posting a revised version on this page.

2. Accounts

Some Site features may require an account. You are responsible for providing accurate information, keeping login credentials confidential, and all activity under your account. Notify us promptly if you believe your account has been accessed without authorization. We may suspend or close accounts that violate these Terms, create security risks, or are used unlawfully.

3. Products, Descriptions, and Availability

We aim to provide accurate product descriptions, images, colors, sizes, and prices. Screens and devices may display colors differently, and minor variations may occur in made-to-order products. Product availability, pricing, specifications, and promotions may change without notice. We may correct errors and may limit quantities or decline an order where permitted by law.

4. Orders and Payment

Submitting an order is an offer to purchase. An order confirmation does not necessarily mean that the order has been accepted. We may cancel or refuse an order for reasons including inventory or production limitations, pricing or listing errors, suspected fraud, shipping restrictions, or other legitimate business reasons. Payments are processed through third-party providers such as Stripe and PayPal and are also subject to their terms.

5. Made-to-Order Production and Delivery

Many products are produced after an order is placed through a print-on-demand model. Processing and delivery estimates are estimates, not guarantees, and may be affected by production capacity, carrier delays, weather, address errors, customs, or events outside our reasonable control. You are responsible for providing an accurate shipping address and reviewing order information promptly.

6. Returns, Replacements, and Refunds

Any returns, replacements, cancellations, or refunds are handled according to the applicable policy displayed on the Site or communicated by our support team for the relevant order. Because products may be made to order, eligibility and available remedies may vary by product and situation. Nothing in these Terms limits rights that cannot lawfully be waived. 7. User-Submitted Content

If you submit reviews, comments, images, designs, suggestions, or other content, you represent that you have the necessary rights and that the content does not violate law or third-party rights. You grant PassionWear Studio a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt, and use that content to operate, promote, and improve the Site and our business. We may remove content that we believe violates these Terms or is otherwise inappropriate.

8. Intellectual Property

The Site and its content, including text, graphics, logos, photographs, designs, product listings, software, and branding, are owned by or licensed to PassionWear Studio and are protected by applicable intellectual-property laws. You may use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, scrape, reverse engineer, sell, or exploit Site content without prior written permission.

9. Fan-Inspired and Original Designs

Our catalog may include original designs and designs inspired by themes, communities, interests, or popular culture. Unless a product or page expressly states otherwise, PassionWear Studio is an independent brand and the relevant design is not affiliated with, sponsored by, endorsed by, or approved by any third-party brand, organization, creator, or rights holder. We do not represent that a product is officially licensed unless that is expressly stated and authorized.

10. Acceptable Use

You may not use the Site to violate law or third-party rights; impersonate another person; distribute malware or harmful code; interfere with Site security or operation; access data or accounts without authorization; scrape or harvest information in a manner that burdens or abuses the Site; submit infringing, defamatory, fraudulent, hateful, or unlawful content; or use the Site for unauthorized commercial purposes.

11. Third-Party Services and Links

The Site may use or link to third-party services, including payment, analytics, email, hosting, fulfillment, shipping, and social-media services. Third-party services are governed by their own terms and policies. We are not responsible for third-party services or content that we do not control.

12. Disclaimers

To the maximum extent permitted by law, our total liability for a claim will not exceed the amount you paid for the product or service giving rise to that claim. These limitations do not apply where prohibited by law.

14. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless PassionWear Studio and its related persons and entities from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Site, violation of these Terms, infringement of another person’s rights, or user-submitted content.

15. Termination

We may restrict or terminate access to the Site or an account at any time where permitted by law. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions, will survive.

16. Governing Law and Disputes

This section is intentionally limited. These Terms do not currently designate a specific governing law, exclusive court, venue, arbitration process, jury-trial waiver, or class-action waiver. Nothing in these Terms prevents either party from asserting rights or remedies available under applicable law. Any dispute will be handled through the forums and procedures available under applicable law unless the parties later agree otherwise in writing.

17. General Terms

If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver. These Terms, together with policies expressly incorporated into them, constitute the current agreement regarding use of the Site, subject to any rights that cannot be waived.
